PROFILE

Jeff is a partner and a member of the firm’s local government law and commercial litigation practice groups.  Jeff regularly provides advice and acts as litigation counsel for local governments in matters pertaining to bylaw enforcement, zoning, tender disputes, development and land use issues and in the defence of property loss and bodily injury claims.  Jeff also provides advice and acts as litigation counsel for large and small companies and private individuals concerning a range of issues including contractual, property and lease disputes, bankruptcy and insolvency issues, and construction disputes.

REPRESENTATIVE CLIENT AND PROFESSIONAL WORK

Examples of legal proceedings in which Jeff has been involved include the following:

• Obtained injunctive relief and contempt of court orders on behalf of a local government pertaining to an apartment building being used as a hotel (upheld by the Court of Appeal).
• Successfully defended action in nuisance and negligence against a large, international railway.
• Successfully defended a catastrophic personal injury claim arising from a landfill accident, both at the trial level, Court of Appeal and through to the denial by the Supreme Court of Canada to hear an appeal of the case.
• Obtained a Court Order protecting a local government from a claim arising from a twenty-one million dollar tender dispute.
• Defended and successfully negotiated resolutions to multi-party "leaky condo" construction/building inspection actions on behalf of a local government and private litigants.
• Assisted numerous local governments in negotiating non-litigated solutions to claims concerning building inspection, land use, by-law and trespass, negligence and nuisance.
